Terms & Conditions

These Terms & Conditions (“Agreement”) govern participation in any tour, retreat, workshop, class, activity, or experience (“Experience”) organized by Vai and Seek LLC (“Company,” “we,” “us,” or “our”).

 

By booking, paying for, attending, or participating in any Experience, the participant (“Participant,” “you,” or “your”) agrees to the following Terms & Conditions and Release of Liability.

1. Assumption of Risk

 

Participant understands and acknowledges that participation in travel, workshops, tours, retreats, excursions, transportation, outdoor activities, cultural experiences, physical activities, and related events involves inherent risks, including but not limited to: Personal injury, illness, property loss or damage, delays, accidents, transportation incidents, weather-related events, food-related illnesses or allergies, theft or criminal acts, acts of third parties, political instability, natural disaster, physical exertion, emotion distress, and death. Participants voluntarily assume all risks, known and unknown, associated with participation in the Experience. Participant is solely responsible for personal belongings and valuables. The Company shall not be liable for lost, stolen, or damaged property.

 

2. Release and Waiver of Liability

 

To the fullest extent permitted by law, Participant releases, waives, discharges, and holds harmless the Company and its owners, directors, employees, instructors, volunteers, affiliates, agents, venues, and service providers from any and all claims, liabilities, damages, injuries, losses, costs, or expenses arising out of or related to: Participation in the Experience, travel to or from the Experience, acts or omissions of third parties, negligence of the Company or others, equipment failure, medical emergencies, force majeure events. Participant agrees that the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages.

 

3. Medical Fitness

 

Participant represents that they are physically, mentally, and medically capable of participating in the Experience. Participant agrees to: Consult a physician if necessary before participation, disclose relevant medical conditions when appropriate, carry required medications, accept full responsibility for their own health and wellbeing. The Company is not responsible for providing medical care, insurance, or emergency services. Participant authorizes the Company to obtain emergency medical treatment if necessary during the Experience. Participant agrees to be solely responsible for all medical expenses incurred. The Company makes no guarantees regarding access to medical care or emergency response.

 

4. Travel Requirements

 

Participant is solely responsible for passports, visas, vaccinations, travel documentation, entry requirements, insurances, compliance with local laws. The Company is not liable for denied boarding, denied entry, missed connections, or governmental restrictions.

 

5. Insurance Policy

 

Participant is strongly encouraged to obtain comprehensive travel, health, medical evacuation, and cancellation insurance.

The Company is not responsible for losses that would otherwise be covered by insurance.

6. Changes to Itinerary

The Company reserves the right to: Modify schedules, substitute venues, cancel activities, change instructors or guides, alter accommodations, adjust routes or timing. Such changes may occur due to safety concerns, weather, operational needs, availability, or circumstances beyond the Company’s control. No refunds or compensation shall be owed for reasonable changes.

 

7. Cancellation Policy

 

All payments are subject to the following policy: Reservation must be cancelled 60 days in advance for a full refund minus a $150 reservation deposit. Should you cancel your reservation after this window, you can apply your credit to future experiences.

 

8. Media Release

Participant grants the Company permission to photograph, record, or otherwise capture their likeness during the Experience and to use such materials for promotional, marketing, educational, or commercial purposes without compensation unless prohibited by law. Participant may opt out in writing before the Experience begins.

9. Code of Conduct

Participant agrees to: Behave respectfully, follow safety instructions, comply with local laws, respect venues, staff, and other participants. The Company reserves the right to remove any Participant whose conduct is unsafe, disruptive, abusive, discriminatory, or inappropriate. No refund shall be provided in such cases.

10. Limitation of Liability

To the maximum extent permitted by law, the Company’s total liability for any claim arising from the Experience shall not exceed the total amount paid by Participant to the Company for the applicable Experience.

 

11. Indemnification

 

Participant agrees to indemnify, defend, and hold harmless the Company from any claims, liabilities, damages, costs, or expenses arising from: Participant’s actions or omissions, violation of these Terms, injury or damage caused by Participant, violation of laws or third-party rights.

12. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

13. Acknowledgment

 

This Agreement constitutes the entire understanding between Participant and the Company and supersedes all prior communications or agreements. By booking or participating in the Experience, Participant acknowledges that they: Have read and understood this Agreement, understand the risks involved, voluntarily agree to these Terms, waive certain legal rights.
